KEY AMENDMENTS IN APPRENTICES ACT 1961
- Abolition of Quota System.
- Establishment has to engage a minimum of 2.5% of its total strength including contractual manpower mandatorily and maximum up to 15% or (25% in Maharashtra) of its total strength including contractual manpower.
- Optional trade apprentices have been included in the category of apprentices.
- Age Group:- from 18yrs to 60 yrs. ( Below 18 Yrs. Considered as Minor required to get approval by Guardian).
- Working Hours:- As per the normal working hrs of establishment wherein apprentices are getting OJT including night shift without any approval from Apprentice advisor or any authority.
- For apprentices under the 18 Years, establishment wherein apprentices are getting On-the-Job Training (OJT) between 8am to 6pm only.
- Minimum Education eligibility criteria for apprentice is 5th Std. Pass and above like 10th, 12th, I.T.I , Diploma, Degree, B.A., B.com., B.Sc., M.Sc., Ph.D., etc…
- Establishment can engage apprentices from other states as well across India.
- Stipend, Training charges and service charge paid to TPA over and above 2.5 up to 15% (25% in Maharashtra) can be considered as CSR.
- Establishment can engage apprentices from other states as well.
